Plan Waiver and Release: You agree that if you are present for any reason, have interaction of any kind with or from anyone else in any physical exercise activity or use of gym, in home, virtual or other locations training, you do so at your own risk. This includes without limitations the use of facilities, locker rooms, equipment, showers, transportation to training events, parking areas, sidewalks and your participation in any activity, class, personal training or other instruction now or in the future. You agree that you are volunteering in these activities and using the equipment assuming all risk of injury or contraction of illness or medical condition that might result therefrom or any damage, loss or theft of any personal property. You agree on your consent to release and discharge Fitness 4 Recovery, its associates and affiliates from all claims or cause of action arising out of our negligence. The Waiver and Release includes without limitation injuries which may occur as a result of (a) your use of the facility or its proper maintenance, (b) your use of any exercise equipment which may break or malfunction, (c) improper maintenance of any exercise (d) our negligent instruction or supervision (e) your slipping or falling in sessions or surrounding premises (f) first aid, emergency treatment or any other services which are negligently rendered or failed to be rendered. YOU ACKNOWLEDGE THAT YOU HAVE CAREFULLY READ THIS WAIVER AND RELEASE AND FULLY UNDERSTAND THAT IT IS A RELEASE OF ALL LIABILTY. IN ADDITION, YOU DO HEREBY WAIVE ANY RIGHT THAT YOU MAY HAVE, BY OR ON BEHALF OF YOURSELF, YOUR SPOUSE OR ANY CHILD (MINOR OR OTHERWISE) TO BRING LEGAL ACTION AS ASSERT A CLAIM FOR INJURY OR LOSS OF ANY KIND AGAINST US FOR OUR NEGLIGENCE, ARISING OUT OF OR RELATING TO PARTICIPATION BY YOU., YOUR SPOUSE OR CHILD IN ANY OF THESE ACTIVITIES OR USE OF EQUIPMENT, FACILITIES OR SERVICES WE PROVIDE AS DESCRIBED IN THIS PARAGRAPH, OR ON ACCOUNT OF ANY ILLNESS OR ACCIDENT, OR DAMAGE TO OR LOSS OR PERSONAL PROPERTY. Plan Details: You agree to monthly billing for the plan, automatically on the same day as this purchase. Sessions not used in the billing period will be valid for 60 days afterwards. Any period with more than your regular number of sessions, payment for those will be due before extra session(s), after credit for any remainders in the 60 day period. Any session cancelled within 24 hours will be billed as completed unless prior authorization from head Coach, Bill Hicks Plans can only be cancelled or suspended by written/email notice 10 days or more before the billing date. Any sessions remaining you have 60 days to use. Suspension of your program will be allowed if no payments are due within the next 10 days. Sessions can resume as needed with payment or with session credits before the suspension. Only 2 suspensions may take place in 12 month period. This agreement contains a waiver and release on the website which you agree to by completing this purchase. You acknowledge receipt of a fully completed copy of the agreement executed by both you and us.
